Terms of Service

1. Acceptance of Terms

By creating an account or using Gesture Drawing Studio (“the service,” “the app,” “GDS”), you agree to these Terms of Service and our Privacy Policy. These terms constitute a legally binding agreement between you and Gesture Drawing Studio.

2. Eligibility

You must be at least 13 years old to use Gesture Drawing Studio. By using the service, you represent that you meet this age requirement and have the authority to enter into these terms.

If you are using the service on behalf of an organization (such as a school or studio), you represent that you have the authority to bind that organization to these terms.

3. Account Responsibilities

You are responsible for:

• Maintaining the security of your account credentials
• All activity that occurs under your account
• Providing accurate and current information
• Notifying us immediately of any unauthorized access

You may not share your account, transfer it to another person, or use another person's account without permission.

4. Acceptable Use

You agree not to:

• Upload or share content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Upload or share content depicting minors in a sexual or suggestive manner (CSAM)
• Use the service for purposes other than personal drawing practice, including commercial file hosting, backup storage, or redistribution
• Upload content that infringes on intellectual property rights, privacy rights, or other rights of third parties
• Use the service to harass, stalk, or harm others
• Attempt to gain unauthorized access to the service or other users' accounts
• Interfere with or disrupt the service, servers, or networks
• Use automated systems (bots, scrapers) to access the service without permission
• Resell, redistribute, or commercialize the service without authorization

We reserve the right to remove content and suspend or terminate accounts that violate these terms.

5. User Content and Ownership

You retain ownership of all images, tags, and other content you upload or create in Gesture Drawing Studio (“User Content”).

By uploading User Content, you grant us a limited, non-exclusive, worldwide license to store, display, and process your content solely to provide and improve the service. This license ends when you delete your content or account.

You represent that you have the necessary rights to upload and share your User Content, and that it does not violate any third-party rights or applicable laws.

6. Intellectual Property

Gesture Drawing Studio, including its design, features, code, and branding, is owned by us and protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, or reverse-engineer any part of the service without our written permission.

Certain reference image libraries provided through Instructor Studios or marketplace packs may be licensed from third parties and subject to additional usage restrictions.

7. Subscriptions and Payments

Gesture Drawing Studio offers both free and paid subscription tiers. Paid subscriptions are billed in advance on a recurring basis (monthly or annual, depending on your selection).

Fair Use Policy: While Pro subscriptions offer unlimited image storage, this is intended for personal drawing practice use. We reserve the right to enforce reasonable limits if usage significantly exceeds typical patterns, is used for commercial redistribution, or impacts service performance for other users. We will contact you before taking action if your usage raises concerns.

Billing: By subscribing to a paid plan, you authorize us to charge your payment method for the subscription fees. Payments are processed securely through Stripe.

Cancellation: You may cancel your subscription at any time. Cancellations take effect at the end of your current billing period. You will retain access to paid features until that date.

Refunds: Subscription fees are non-refundable except as required by law. We do not provide refunds for partial billing periods.

Price Changes: We may change subscription prices with at least 30 days' notice. Continued use after a price change constitutes acceptance of the new price.

8. Instructor Studios

Gesture Drawing Studio may offer branded sub-platforms (“Instructor Studios”) operated by licensed educators or organizations. Access to Instructor Studios may be subject to additional terms, pricing, or access controls set by the instructor.

We are not responsible for the content, accuracy, or quality of materials provided through Instructor Studios.

9. Third-Party Services

Gesture Drawing Studio may integrate with third-party services such as Pinterest, Google Drive, or Dropbox. Your use of these services is governed by their respective terms and privacy policies.

We are not responsible for the availability, content, or practices of third-party services. You use them at your own risk.

10. Termination

You may delete your account at any time through the app settings or by contacting us.

We reserve the right to suspend or terminate your account if you violate these terms, engage in abusive behavior, or for any reason at our discretion. In the event of termination for cause, you will not be entitled to a refund.

Upon termination, your data will be deleted in accordance with our Privacy Policy.

11. Disclaimers

Gesture Drawing Studio is provided “as is” and “as available” without warranties of any kind, either express or implied.

We do not guarantee that the service will be uninterrupted, error-free, or secure. We are not responsible for data loss, even if caused by our systems.

You use the service at your own risk. We strongly recommend keeping backups of important content.

12. Limitation of Liability

To the maximum extent permitted by law, Gesture Drawing Studio and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising from your use of the service.

Our total liability to you for any claim arising from these terms or your use of the service shall not exceed the amount you paid us in the 12 months prior to the claim.

13. Indemnification

You agree to indemnify and hold harmless Gesture Drawing Studio, its operators, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the service
• Your User Content
• Your violation of these terms
• Your violation of any third-party rights

14. Dispute Resolution

Governing Law: These terms are governed by the laws of the United States and the state in which Gesture Drawing Studio operates, without regard to conflict of law principles.

Arbitration: Any dispute arising from these terms or your use of the service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court.

Exception: You may pursue claims in small claims court if they qualify.

Class Action Waiver: You agree to resolve disputes on an individual basis and waive the right to participate in class actions or class arbitrations.

15. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of material changes via email or an in-app notice.

Your continued use of the service after changes take effect constitutes acceptance of the updated terms. If you do not agree to the changes, you must stop using the service and may delete your account.
